For the purposes of applying the 'lawful purpose' test in the provision relating to bona fide applicants (see E5.1) visitors are considered to be coming to New Zealand for a lawful purpose if:
a.they are coming for the purposes of:
@;holidaying
@;sightseeing
@family and social visits
@;amateur sport
@;business consultation
@;medical treatment; and
b.they are not intending to undertake employment* (see W2.1.1) or a course of study or training, other than a single course of study or training that lasts no more than 3 calendar months.

It is noted that the applicant had indicated on the application form that the intended visiting period is from 1 November to 1 December 2009; however, as there must be a recognised purpose for the limited purpose visa, we do not see a lawful purpose for his intended period. We offer the period during October is that he could spend the National Holiday in New Zealand. Please note that "visiting family member" or "travel" are not lawful purposes for the limited purpose visa.

Thanks for your explanation.
As my brother is working for a company that is owned privately, his working time is totally different from others. There are 3 shifts 24 hours, each shift is 8 hours, the machines in his company are also running 24 hours 7 days and never shut down. Except Chinese Spring Festival, they can not take other hoildays at the normal time like other workers in China, even like National Holiday, Labour Day, New Year, etc.
However, those holidays can be accumulated and used at one time on the premise of getting the consent from his company. My brother accumulated his holidays since he started to work there in October 2007, he has to work during every National Holiday. It is also the reason why his company only allows that my brother can only take holidays for 1 month from 1st November to 1st December 2009. Therefore, my brother's intend visiting period is from 1 November to 1 December 2009 not National Holiday. ( My brother can provid the proof from his company for your reference if you need it.)
We will be very appreciate if you can grant the period during November, thanks a lot.

It is OK for you to travel for period from 1 November to 1 December 2009 if you have a lawful purpose. We are offering the period in October as there is National Holiday around the corner. If you do not have a lawful purpose, the limited purpose visa can not be granted.
