标题: flatting合同，但房东租期内想涨房租，请问该怎么办？ [打印本页]

就是我和我现在的房东签了一个fix flatting agreement，租期和租金在合同里有明确注明，但是没有标志租期内可不可以涨房租。但是房东突然通知我要涨房租，我不乐意就想搬走，但房东看我要搬就说不涨了，但我还是要搬走，她现在就拿这个合同说事，就是说要走可以，磅金不退，且让我马上搬家[流泪][流泪][流泪][流泪]我自己在网上查到的法律都是tenancy的，但我是flatting，就不知道有没有法律可以保护我这种情况

flatting也要提前给通知，并且不能扣押押金，去告她就好，稳赢的事儿

没有经验，但是他不能赶你出去吧。不然你房东到时等着赔款吧，你留着证据先。

你不搬就行呀他不能把你东西扔出去把?

他让你搬家, 可以,出书面证明终止合同, 写好搬家日期. 从现在起, 他和你的任何沟通都需要邮件往来, 口头一律不算. 包括涨薪, 留好证据呀

嗯嗯，我都尽可能的微信沟通，留好证据要告他，但是他要涨房租我没有文字证据，但是我其他3名室友可以帮我作证她要涨房租，因为她是强制涨了所有租客的房租，不只我一个。

别微信了，以后直接邮件，写英文。要不然带上tribunal 你还得翻译。跟他说，如果要赶你走，就书面通知，14天Notice，你不可能明天搬家，他又不能把你东西扔出去，怕啥

我倒也想，我这房东一句英语不会说，不得已才用中文，连签的agreement都是中文的，翻译就翻译吧，反正都要上tribunal了，也不差那些麻烦了

很遗憾的是 flatemates 不受 Residential Tenancies Act的保护，如果你要去 Tenancy Tribunal 很大的机率是他们不受理会叫你去 Disputes Tribunal.

What is a flatmate?
If someone else signs the tenancy agreement but lets you share the flat, you are a flatmate. Flatmates live in the property but are not part of the tenancy agreement.

Flatmates are not responsible to the landlord for the rent and the state of the property. They are responsible to the tenant for their share of the rent.

Flatmates are not covered by the Act. Their rights depend on the agreement they have with the tenant.

Flat-sharing agreements between tenants and other flatmates are not covered by the Act. If you are a flatmate, record your agreement with the tenant in writing. You can download our flat sharing agreement template below.

Solving problems between tenants and flatmates
Only landlord-tenant disputes are heard by the Tenancy Tribunal. If there are any issues between tenants or flatmates, you can go to the Disputes Tribunal.

好像不太行吧涨租要通知吧
就算你不住那你想什么时候搬就什么时候走，他不可以规定你的啊，bond也不可以那样的
不过，fix合同，不可以不租吧，你要是不住的话可以但是还是要付全部房租直到合同结束的吧
或者是交房租直到他或你找到房客来替代你

我们argeement里写了，如果任意一方违约只需要付磅金就可以。

flatting 标准合同一般是14天notice，任意一方。 (6. This agreement can be terminated by 14 days’ notice given by either party in writing.)

有些明显不合理的合同就是不会被生效的，但是flatting 合同好像是不受租客法律保护。具体你咨询一下律师吧，有社区免费那种。

合同上应该写了至少2个星期通知。

然后你也别付租金！！！记住：一分钱都别付！！！

三个月后他会求你搬的！记住：在新西兰，租客才是爷！碰到那些不讲道理的华人房东，你就要用特殊的办法去解决。
