We own a cross lease town house. Our private drain was blocked by neighbour's vine root. We have asked them to consider removing the vine and do the proper root treatment. But they refused it.
The cause of blockage was root infiltration from our neighbour’s grape vine near the drain According to the opinion from professional arborist that we have consulted, the grape vine grows very fast and the drain may get blocked again.
Neighbour refused our request. Can we get a professional arborist to remove the plant and do root treatment without neighbor's permission? Can you please quote council's rule and other legal description on this issue?
