砍树与邻居争议

赵律师好！

We own a cross lease town house.  Our private drain was blocked by neighbour's vine root.  We have asked them to consider removing the vine and do the proper root treatment.  But they refused it.


The cause of blockage was root infiltration from our neighbour’s grape vine near the drain According to the opinion from professional arborist that we have consulted, the grape vine grows very fast and the drain may get blocked again.


Neighbour refused our request. Can we get a professional arborist to remove the plant and do root treatment without neighbor's permission? Can you please quote council's rule and other legal description on this issue?

如何邻居的树叶长到了你的地界，你可以砍掉你地界内的那部分避免进一步的堵塞。在邻居范围内的葡萄藤，那是他的树，他有权决定砍不砍。

如果邻居界内的树叶掉到你的地界，造成堵塞，而且邻居不肯赔偿的话，通常是你先付钱找人修了然后上dispute tribunal去告邻居。如果赢了，邻居就要付费法院会强制执行。

修理的时候，最好让修理的人写个导致排水堵塞的原因（比如，因为邻居境内的树叶飘过来导致的），多拍点照片显示堵塞物为树叶，这样赢面很大。

在告之前要把你写给法院的东西先发给邻居，并告诉他如果7天内不回复不付钱，你就 go ahead去告了。

虽然树叶继续落可能会继续堵，但你不能就没有发生的事情要求赔偿或者要求对方砍树。你只能就已经发生的费用，比如修理费要求对方的赔偿。如果对方愿意一直付修理费，也不肯砍树的话，也是无可奈何

是邻居院内的葡萄树树根堵了我的下水道。有专业修理工证明。每次堵塞找人通下水管道都有绞碎机严重损坏管道的可能。 我希望上dispute tribunal 得到要对方砍葡萄树的强制执行令。 请各位给建议。

是的，要强制对方砍树，只能这样
