To elaborate and also correct my previous comment, the proposed changes in the Immigration Act 2009 Amendment Act 2010 (Immigration Act 2009 Amendment Bill now in Parliament, through 1st reading, 2nd reading, In Committee, 3rd reading) stated the following:
s. 73 (a) Currency and nature of permanent resident visa states:
The holder of a permanent resident visa is entitled to travel to New Zealand at any time.
s. 74 (1)(a)(i) and s. 74 (2) Currency and nature of resident visa states:
The holder of a resident visa is entitled to travel to New Zealand only if the visa holder’s travel to New Zealand is consistent with the conditions of the visa relating to travel.
s. 49(1) and (2)(b) Visas may be subject to conditions states:
Every visa other than a permanent resident visa is subject to such conditions (if any) and the conditions of a visa relating to travel may give permission to travel to New Zealand for or within a specified time period.
s. 50(5)(b) Conditions on resident visas states:
To avoid doubt, nothing in this section allows the Minister to impose conditions on a permanent resident visa, whether at the time or subsequent to granting the visa.
s. 108 (1) Decisions on entry permission in relation to residence class visa holders states:
The holder of a permanent resident visa must be granted entry permission.
Schedule 5 Part 1/2 Visas corresponding to visas held under former Act by persons who are outside New Zealand / onshore states:
Resident permit and returning resident’s visa of indefinite duration holder under former Act is deemed to hold permanent resident visa under this Act.
The above provisions pretty much guarantees that the new permanent resident visa will still be valid indefinitely (for as long as this Act is in effect). They also prevent any conditions be imposed on the new permanent resident visa (i.e. to be present in the country for certain number of years within a specific timeframe).
However, the wording of schedule 5 (it is only a schedule) is somehow vague and does not completely rule out the possibilities that some conditions may be imposed when new permanent resident visas are re-issued to replace current IRRVs, although I personally think it is highly unlikely.
Note: I did not read through the whole Act, so misinterpretations and overlooks maybe possible. Criticisms are welcome. |
