You are wrong, it is not city council's decision to build this prison there but the Department of Correction (DoC)...
Also, Council is quite limited in terms of power to approve/decline this prision development as this land is owned by the Crown (the DoC) and designated for the public work purpose (a prison), which is exempt from the development controls of District Plan (which controls the height, the bulk, locations, and the look, etc of a new building) - which means the DoC can basically do whatever they want on their land if it meets the "concept plan" (the special set of development controls for the prison - which does not appear to have any rule on the height restriction @_@) requirments and just notify Council of their design (note, the DoC is not seeking approval but just notify council).
Council, if not happy, can only ask the DoC to change the design rather than decline the proposal. And, if the DoC does not agree with the proposed changes, the matter can only be resorted to the Environment Court.
Dont think city council in New Zealand is that powerful, in many cases, it is just a lame duck... |
