律师你好 想问一下关于Holiday Pay的问题

我工作没有满一年
老板说我有工资8%的Holiday Pay，但是没满一年没有法定公共假期的pay。也就是说公司放假 圣诞和新年的四天工资是没有Pay的。请问这是正确的吗？

还想问一下难道节假日的工资是算在那个8%里面吗？

哈哈哈哈哈！明显恶心雇主在混淆Holiday Pay和Public Holiday。只要Public Holiday那天原本你是要上班的，雇主就该付你工资。对参加工作时间没有要求，试用期都得给。

There are 11 public holidays (also known as statutory or stat holidays) provided under the Holidays Act 2003. All employees are entitled to public holiday benefits whether they are casual, fixed-term, part-time or full-time. Public holidays are in addition to annual holidays and there’s no minimum period of time an employee has to be employed to get public holiday benefits.

Public Holiday是一码事， 8% Holiday Pay/Annual Leave是另一码事。不要被恶心雇主给你绕晕！

今年的圣诞节恰好是周末呢，这个该怎么算呀？是否就不用给了

如果国定假日没有上班的话就是没有holiday pay的啊，只有在那天上班才有。

新西兰的Public Holiday但凡是在周末的，都会自动转到下周非Public Holiday的日子。你看看日历，是不是圣诞、新年之后的周一全部也都是Public Holiday？如果你周一本来是上班的，这两个周一就得有正常工资。如果你平时都是周一至周五上班，新西兰全年的Public Holiday统统有Pay，而且这11天还要累计到8% Holiday Pay/Annual Leave里。

如果是这种情况，老板应该说“圣诞新年的周一虽然是Pubilc Holiday，但是你在周一本来就没有排班，所以没有Public Holiday Pay”。“没满一年没有法定公共假期的pay”这种说法完全不合法。

不好意思呀，我现在有点糊涂,我们公司现在是这种情况，我是周一到周五上班。但是现公司放年假从12月23放到1月15。这期间是不上班的那请问我有没有这个Public Holiday pay

During a business close-down period
If a business has a close-down period that includes public holidays, for example, over the Christmas and New Year period, then the employee is entitled to a paid public holiday if they would have normally worked on that day if the closedown was not in effect.

During annual holidays
If an employee is on annual leave when there’s a public holiday, they get a paid public holiday if they would have normally worked on that day, and do not lose an annual leave day.
