The question is you knowingly know there is an issue and still buying it.
The vendor does not have to disclose and leave it to the Buyer to do their own due diligence.
I will even say further if i were selling an old house i will put in a clause of "selling as is where is basis as seller having not living in this property and acting as a trustee and exclude himself from all warranties if any" thus buyer must rely on its own due diligence.
