It is really getting odd, but can you let us know:
- What was the original resource consent actually about? I have been involved in this
sort of thing for nearly 10 years but have never seen a NON-subdivision resource
consent would contain a condition about drainage/stormwater, it really opens my
eyes! Mind you, even a site was cross-leased, it still required a subdivision
consent and s224c, etc.
- It sounds really weird to me that it was Council first pointed out the problem then
directed you to your lawyer for further information. I suggest you to contact that
council's officer again and ask for further information:
What you should do now and what is the consequence if you fail to comply?
If Council asked you to talk to your lawyer, in a cross-lease situation, it may be
simply a civil matter, which means it is not Council's business.
- I suggest you to get a new lawyer if this may help. I dont think your lawyer is very
knowledgable in this area.
- As I said before, there is no mechanism for a compliance certificate for resource
consent conditions (other than s224) under the Resource Management Act, so non-
compliance with some resource consent conditions is sometimes inevitable/possible.
Unless someone lodges a complaint or the matter was found out by Council, it may
not be even known to Council. Even if it was identified, it is not really the end of the
world but rather subject to the seriousness/nature of the non-compliance before
Council decides what action(s) to take. You will be given sufficient time to remedy
any problem/issues by this non-compliance.
- Finally, if you are not confident at all and the matter is not sorted, simply dont buy it - you got the choice and it is the owner's loss!!! |
