问题一:  我在holiday act 2003 section 66中查到,说当年没有使用sick leave是可以carry forward到下一年,一直累积到最多20天。我在这家公司做了3年,以前一直没怎么请病假,所以以为自己是有累计到15天的。去年生了宝宝,请病假频率变高了,刚用完5天,老板就说公司policy不可以carry forward病假。而这个问题,雇佣合同里也没有写明白,只写了每年5天。请问,老板这样做合法吗?

问题二:   老板说我产假7个月期间没上班,产假期间没有sick leave和annual leave。两种假期都从我5月恢复上班后才开始重算,所以截止目前上了3个月班,只有3/12*5=1.25天的sick leave。年假同理。请问他这样算对吗? 我产假期间not entitled to sick / annual leave吗?如果我是有权在产假期间拿年假,钱数是和正常工资时薪数一样吗?
例如: 我休了7个月产假,累积是160小时*7/12=93小时年假,是按照正常薪水数字来计算这93小时吗?

产假期间是有AL的, sick leave不是很清楚~

sick leave 看公司的貌似 有的给累积

产假期间肯定继续算AL的。SickLeave不是每个公司都可以累计到20天的,看公司的policy了。

66Sick leave may be carried over
(1)An employee may carry over, to any subsequent 12-month period of employment, any sick leave that has not been taken by the end of the period to which the leave relates.
(2)For the purposes of subsection (1), an employee may carry over up to 15 days’ sick leave to a maximum of 20 days’ current entitlement in any year.
(3)To avoid doubt, subsection (2) does not prevent an employer from allowing an employee to carry over any enhanced or additional sick leave entitlement

根据以上规定,病假可以累积使用,最多不超过20天,但雇主可以不限制积累上限。你的合同中没有这方面的条款,那自然以act规定的法律底线为准。很多孕妇都会在休产假前把积累的病例使用掉,同时把积累的年假延续在法定的产假上。

关于第二个问题,Act中说,雇员有权获得病假年假如果持续为雇主"工作",条款词汇是working,  而不是用"劳资关系的存在"这样的表达。我的理解是,雇员的年假是可以在产假期间继续累积(其中有十四周带薪假),但我认为休完产假再回来上班后,病例要从头开始计算积累,因为在回来上班的前七个月,楼主没有持续工作,而是处于休假状态。
下周我会给劳工部打个电话,给你一个更确切细致的答复。我的专长是unfair dismissal 和personal grievance 方面的劳资官司.

年假计算可以8%的税前收入为准,在你的产假期间,只是十四周是带薪的,其余都是unpaid, 所以我认为楼主的算法有误。

非常感谢回复。但我现在问题是,雇主说我们公司政策不累积病假,所以我前两年没有使用的病假就直接全部清零了。这样符合法律规定吗?

这个应该要看你合同上怎么定的吧。工作第一天,就签合同,难道没有看就签了

你原来积攒的病假,在你休产假前应该是可以使用的,但现在你的病假已又开始新一轮的积累,原来没有用的,应该是不能用了,你可以dispute。

ANNUAL LEAVE的小时数你在放产假的时候会积攒,但是放产假时候积攒的那些假你最好等产假后工作一年满后用,不然你的RATE会很低。

关于annual leave的计算问题:

An employee's time on parental leave is included as continuous service and the taking of parental leave does not affect entitlement to annual leave; the employee will still be entitled to a minimum of four weeks of annual holidays. However, the payments for the annual holidays will be affected by the parental leave.

Normally payments for annual holidays would be based on the greater of:

•Average weekly earnings for the 12 months immediately before the end of the last pay period before the annual holiday is taken; or
•The employee's ordinary weekly pay as at the beginning of the annual holiday (the amount of pay the employee receives under his/her employment agreement for an ordinary working week).

However, under the Parental Leave and Employment Protection Act 1987, if an employee becomes entitled to annual holidays while they are on parental leave or in the 12 months following any parental leave, the calculation changes. The payment amount will then be determined by calculating only the employee's average weekly earnings for the 12 months immediately before the end of the last pay period before the annual holidays are taken.

The calculation would not be compared to the ordinary weekly pay as would normally occur. This means that if the employee takes their annual holidays soon after coming back from parental leave there is a high likelihood that the payment for annual leave may be a smaller amount than if they took their annual leave at another time.


Annual leave is always calculated at the time the employee takes their leave.
