Determination

[7] I am satisfied that Beagle Brothers has not complied with the terms of the
Authority’s determination of 23 October 2014. Beagle Brothers is to pay the
following sums to the Labour Inspector within seven (7) days of the date of this
determination:

a) $6,587.56 gross in outstanding wages and holiday pay plus interest to be
calculated at the rate of 5% per annum from 23 October 2014 to the date of
payment for the use of Ms Junxia Dong ;

b) $4,001.40 gross in outstanding wages and holiday pay plus interest to be
calculated at the rate of 5% per annum from 23 October 2014 to the date of
payment for the use of Mr Manching;

c) $12,000 penalty; and

d) $71.56 being the filing fee in respect of the determination.

Auckland restaurant owner fined again

A Japanese restaurant in Auckland has been hit with a $12,000 fine for underpaying two migrant workers and authorities say the owner is a repeat offender.

Junxia Dong and Julius Manching were employed by Beagle Brothers Limited, trading as Genji Ponsonby, but left the restaurant over non-payment of wages and holiday pay.

An inspector from the the Ministry of Business, Innovation and Employment investigated and found the pair had not received statutory holiday pay and were still owed wages.

Ms Dong was paid $40,000 per annum during her two years at Genji, while Mr Manching had an yearly salary of $45,000.

Neither took annual leave during their employment and were not paid for their final four weeks at the restaurant.

The ministry's labour inspectorate launched action against the restaurant before the Employment Relations Authority (ERA), which ordered business owner William Tan to pay his employees and fined him $12,000.

Inspectorate northern manager David Milne says Beagle Brothers' owner is known to them and has previously been reprimanded by the Employment Court.

"Unfortunately this is not the first time that we have had dealings with the owner of this business," he said.

In its ruling released on Friday, the ERA said Tan has already been penalised $6000 in another case and ordered to repay $7000 which he had charged an employee a premium for him giving them a job.

Mr Milne said cases of migrant workers being exploited by local employers had increased.

"The exploitation of migrant workers is not welcome here and breaches New Zealand law," he said.

就这家参观老在grabone上卖特价，东西还特别不好，只能骗一次，谁都不去第二次。。

看看company office 的注册信息，老板是中国人。而且看另一个案子的判决书，也不难推断老板的身份。
