ERA案例:
曾任职于惠灵顿中文报纸 New Zealand Chinese Times的前雇员Yu 先生把公司告上了ERA法庭,老板Bill Li 和Liang Qiu代表公司出席了法庭调查。- C1 P8 m; m9 B, t1 Y: ^5 C2 \
Yu先生的建设性辞职的请求没有获准(ERA认为Yu先生遗弃他的工作),但他的其它诉讼请求得到ERA的支持。
看来拖欠工资的问题很普遍啊。$ X/ j# _2 o1 V8 a( n

[51] Symbol Spreading Limited is required to pay Mr Yu:

在Yu先生和公司签订的合同中有以下的条款,
TRAINING
4.1 The employer will provide the Employee with on the job training. The cost of this training is the equivalent of three months salary. ' r6 o- H7 d3 ?8 }

Chinese Times (Symbol Spreading Limited)据此向原告提出了“赔偿”(counter claim)要求,但是没有得到法庭的支持。因为法庭认为,讨要“培训费”等同于“This claim amounts to a premium for employment”。
