Demolition of Earthquake DamagedBuildings
Heritage & Character Buildings
These buildings contribute significantly to theidentity and character of the city.
In all instances the Council would like propertyowners to contact the Building Recovery Office prior to undertaking any work sothat all options are explored before the decision is made to demolish thesebuildings.
The office is intended to be in a position to provideimmediate advice.
The Building Approval Team will ensure that heritagestaff are aware before any exemption for demolition is given.
Urgent Work
Currently all demolition work requires a buildingconsent to comply with the 2004 Building Act.
Under section 41 of the Act, work without buildingconsent may be carried out for the purpose of saving, protecting life or health,or preventing serious damage to other property.
The extent of work that can be done is limited to thatrequired to protect people or property.
Where this urgent work is necessary, the Council requiresthat building owners engage a CPEng structural engineer to prepare a ‘demolitionmanagement plan’* and supervise the demolition work.
Once the work for ‘making safe’ has been completedowners are then required to apply for an exemption which will be issued byCouncil under the provisions of Clause (k) of the 1st Schedule ofthe Building Act 2004.
Exemptions for Demolition
Council has decided to utilise Clause (k) of the 1stSchedule of the Building Act to its full extent in an effort to offer astreamlined process for those wishing to carry out demolition following therecent earthquake.
For Council to consider that a building consent is notnecessary under the application of clause (k) it must be satisfied that –
1)
The building work is unlikely to be carried out other than in accordancewith the Building Code or
2)
If carried out other than in accordance with the Building Code isunlikely to endanger people or any building, whether on the same land or anyother property.
Council will require certain information fromapplicants that demonstrate how work will meet these provisions.
An application and worksheet is available whichidentifies the information applicants need to provide which includes –
- Photos of the site and existing building(s)
- *A Demolition Management Plan (Required for commercial or larger scale residential buildings and all buildings close to the boundary). Demolition management plan documents to be produced by the Structural Engineer should include –

A description of thecurrent state of the building, degree of damage etc.

A description of anypreceding works to make the building safe

A description of theprocedure for demolition

Describe the measuresrequired to prevent damage to adjacent property

Describe the effectson any adjoining buildings that may have relied on the building beingdemolished for structural stability / party walls.

Describe a trafficmanagement plan (this could be provided by other suitably qualified persons)

Describe hoardings,fences and any other provisions required to protect members of the public.

Include instructionsfor contractors related to the safe removal and disposal of asbestos and anyother hazardous substances on or in the vicinity of the site e.g gas.cylinders, fuel tanks.

The Engineersqualifications, name and signature.
- Information to advise where materials will be disposed of.
- A list of all contractors involved on the project and their qualifications / experience.
- Verification that power, gas and communications suppliers have been notified and disconnection arranged.
- Any site plans or other sketches where necessary to indicate the proposed work.
- Details of any correspondence with heritage consultants and Councils heritage staff.
Conditions
Exemptions may include certain conditions to ensurethat work will be conducted in a manner that we can be satisfied that therequirements of Schedule 1(k) will be met.
Inspections
Council must be notified when work is complete soinspection of the work can take place.
Charges (including GST)
Commercial and large scale residential buildings -$400.00 fixed fee
Residential dwellings - $280.00 fixed fee
For large scale buildings (e.g. high rise) anexemption may not be granted and a fast track building consent process will beprovided. Building consent fees will apply to these applications.
It is Councils intention to issue these exemptions atthe time of application where possible. Applicants are encouraged to supply allof the requested information to allow this to occur.
