请问Garage改的房可以买吗

看上了一个房 92年前建的
当时是建的garage  之后改成了dwelling
地段非常好 房子现在改的也挺好  
但是现在房主决定不再做任何work了  相当于现在这个dwelling没有legalize  
房主已经报给council知道了 council认同了房子现在是作为dwelling  而且是appropriate for its use
但是如果想legalize这个用途  必须出一个第三方report  之后是不是会涉及到 有很多地方要报批consent？
请问这个房子能买吗。。 后期是不是会有很多麻烦  想legalize全套做下来是不是得花大价钱这种房子  银行能同意给贷款吗？

再看了看你email 那個Tauranga City Council 網站的link 下面是原文 基本就是我說的safe and sanitary report  和我上面說的Auckland Council 情況基本一樣  大概新西蘭全國大小城市的councils也是這樣處理：


Third party building reports can be received by Council and added to a property file in certain circumstances.

Tauranga City Council receives independent third party building reports for:

unauthorised building work that was undertaken before 1 July 1992
building work completed pursuant to a building permit issued prior to 1 July 1992
building work exempt under schedule 1 of the Building Act 2004 (at time work was undertaken).
The reports will be placed on property files as a public record only.

Each report will be read by Council staff, but it should be noted:

The council does not accept any liability for the content of the third party report.
The council does not accept responsibility for the accuracy of the third party report.
Under the Building Act, the third party report is not a CCC (Code Compliance Certificate).
The Council is not obliged to issue a CCC as a result of receiving the third party report.
The third party report will not authorise any building works undertaken without a building consent.
The third party report will not limit the council’s ability to enforce the provisions of the Building Act in the future.


所以 這個third report 根本就不能為這個史前沒有報批的 dwelling 改建就 building act 方面合法化的  只是權充一個擺設而已

银行贷款不，你问银行去，在这里问什么。最多你把拍卖文件看看上面提没提这个事，如果没提，你这一切都是杞人忧天。陶朗加的council可乱了。另外这房子在哪个区，什么叫位置好？那个地方的房价已经比较高了。

我们曾经准备给一个房子的一楼申请COA，

时间有些不够我长话短说做的什么工作

找工程师和设计师

找专业公司在房子的不同地方的水泥地基钻洞测地基的厚度(拆了点瓷砖和地毯)，扫描地基里是否有mesh.

这些都是在工程师在的时候做的，并且工程师出report.

拆了一部分墙看里面是否有保温棉（按照要求是内墙板全拆)

电工水工到场出电线水管的报告，这个很难

外墙有做的不否和规定的地方(我们要做一圈nib wall, 最近准备做，很费时间)

.......

还有其它的，时间有些久了忘记了。

这些地基框架还有保温棉电和水是必须的。

这种房子买来自住是非常理想的，出租会麻烦些。

my one is legal home and income after the amendment. and rental appraisal can be provided by agent and bank also takes it for loan ..

It seems yours is different from my one. make sure you get ccc or you will need to apply for ccc...

哇，你这个要是出租的话，碰到老江湖租客，你可能会被玩死。

是哇 所以这个房子就适合现金买家  买来自住  
我是要靠现在的房子equity再套一个出来 所以必须要按照投资房的流程走  这房子银行估计不给贷款
但是位置实在是好

Will banks take this kind of property for a loan?

說得有點亂啊 既然屋主不打算繼續申報 那為什麼要和council說呢？而為什麼什麼都沒做 council又會說這個是appropriate？

不過如果樓主房子是在奧克蘭的話  目測你說的appropriate 是指planning (土地用途)方面 是的 現在是可以這樣改做所謂的second dwelling 了 好快就是連停車位都不需要  所以就更沒有問題了

但building 方面 假設是沒有BC (而不是有BC 沒有CCC 有BC就基本上是legal了 只是沒完工許可而已） 要搞清楚這個改建是什麼時候做的 如果能證明是1992年後的 可以申請COA (Certificate of Acceptance) 來legalise 不然的話 就只能做你說的safe and sanitary report (還有保溫棉, healthy home 這些) - 而這個報告只是放到property file 聊勝於無而已 不代表它就是legal council不會承認它是legal 只是不採取執法行動而已（如果沒有即時危險的話） 事實上 對於這些史前改建 你是legalise 不了的  只能把相關東西都拆變回車庫  或者拆了再申請BC然後再重做才能合法化
