Good morning Sir/Madam
I am a NZ Permanent Resident in xxx. I got my NZ Residency April 2009.Under the Immigration Act 1987 I believe that i will be in title to apply for IRRV in April 2011.
However from my understanding on the Immigration Act 2009,IF it will take into force in late 2010 then I believe that IRRV will no longer exist? In other words, there will be two new types of visa under residence class visa: Permanent resident visa and resident visa?
My question is which type of the residence class visa I will get when my current returning resident's visa expires ( which will be in April 2011)?
My friends and I would be most appreciated your effort to answer the above question.

You are correct that from the date of the commencement of the Immigration Act 2009, RRVs will no longer exist, however many of the current policy settings from the status quo will be replicated as much as possible under the new system. To provide more detail, I have broken down your query into two parts.
What will you hold when the Immigration Act 2009 commences?
You will be deemed to hold a resident visa with travel conditions. Like a residence permit, a resident visa will allow you to remain indefinitely in New Zealand. The travel conditions will allow you to re-enter New Zealand as a resident in a similar way to your RRV, and will have the same expiry date as your RRV. So although there will be changes "behind the scenes" you will not notice any difference in travelling in and out of New Zealand as long your travel conditions are valid (i.e. until April 2011). Information about what holders of visas and permits under the Immigration Act 1987 will be deemed to hold under the 2009 Act can be found at Schedule 5 of the 2009 Act.
What can you apply for instead of an indefinite RRV?
The permanent resident visa will fulfil the a similar purpose to the indefinite RRV, that is, to allow residents who have shown a commitment to New Zealand to have the indefinite ability re-enter to New Zealand. Cabinet have agreed that the criteria for a resident visa holder to apply for a permanent resident visa will be based on the current criteria for an indefinite RRV, however the exact policy wording has not yet been finalised. It will be released later this year.

My friends and I would like to say thank you for your promote reply and such useful information.
Further to that, we do have a confusion of what you have mentioned in your last email and would like to get more information about it:
In your last email, you mentioned that I will hold a resident visa with travel conditions when the Immigration Act 2009 commences? Does that mean that I need to change my current RRV and apply for the new RV even I am still in NZ? Or should I just do nothing about it and apply for the new PRV in april 2011(if I shall and will be in NZ this whole time)?

Dear XXXXX,
Apologies for the delayed response. You do not have to make any changes to your immigration status. On the commencement date of the 2009 Act, all holders of non-indefinite RRVs will be considered to hold resident visas with travel conditions instead. On this day, our system will automatically change your status accordingly, you do not have to change the labels in your passport.
