That is how i see it.
The Court of Appeal will decide on compensation rather than stopping the development totally. The question is quantum (amount), if there is a breach. The compensation will not be on the developer, it is on the Council who decided on the RC, the developer applied and approved and built according to the plan prepared for the Council.
So, the Council might end up paying the compensation to the neighbors affected.
Where did the Council get the money from? from the rates payers. So, happy ending.

Developer said he has done nothing wrong, he applied, Council said it is "non-notified" and approved, we built according to Council approval. So, it is council fault and will have to foot the bills. |
